Terms of Service

1. Acceptance of Terms

By accessing or using Different Baits (the “Site”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site.

These Terms apply to all visitors, registered members, and any other users of the Site.

2. Who We Are

3. User Accounts

You may sign in using your Google account. By doing so you authorize us to receive your name and email address from Google and use them solely to identify you on the Site.

You are responsible for maintaining the confidentiality of your account. We reserve the right to suspend or terminate any account that violates these Terms.

4. Voting

Registered members may cast one vote per active battle. Votes may be reassigned to the other image before a battle closes. Votes cannot be transferred, sold, or automated.

We reserve the right to remove votes that we believe are fraudulent or produced by automated means.

If a battle includes a giveaway prize, winners must provide a valid shipping address in the contiguous (Lower 48) United States. We may select an alternate winner if the selected winner is outside the Lower 48.

5. Content

All fishing photos displayed in battles are selected and uploaded by the site administrators. By submitting a photo to the administrators for potential use, you warrant that:

• You own the photo or have the right to license it.
• The photo does not infringe any third-party copyright, privacy right, or other right.
• The photo does not contain illegal content.

You grant Different Baits a non-exclusive, royalty-free, worldwide licence to display your submitted photo on the Site and in related promotional materials.

6. Advertising

Advertising slots on the Site may be purchased via Stripe. Payments are processed by Stripe, Inc. and are subject to Stripe’s own Terms of Service. Advertising is sold on a fixed-term basis; refunds are at our discretion.

We reserve the right to reject any advertisement that we deem inappropriate, misleading, or contrary to the spirit of the Site.

7. Prohibited Conduct

You agree not to:

• Use automated tools to vote or interact with the Site.
• Attempt to gain unauthorised access to any part of the Site or its infrastructure.
• Upload or submit content that is defamatory, obscene, or unlawful.
• Interfere with or disrupt the Site or servers connected to it.
• Impersonate another person or entity.

8. Intellectual Property

The Different Baits name, logo, design, and all site-generated content are owned by Paul Sturgill and may not be reproduced without prior written permission.

9. Disclaimer of Warranties

The Site is provided “as is” and “as available” without any warranty of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components.

10. Limitation of Liability

To the fullest extent permitted by law, Paul Sturgill shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site.

11. Governing Law

These Terms are governed by the laws of Massachusetts USA, without regard to its conflict-of-law provisions.

12. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated date. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
